УЛОГА И СТАНДАРДИ ВЕНЕЦИЈАНСКЕ КОМИСИЈЕ У ПОСТУПЦИМА ДОНОШЕЊА И ПРОМЕНЕ УСТАВА
Сажетак
Овај рад анализира улогу Европске комисије за демократију путем права Савета Европе у поступцима доношења и промене устава, полазећи од класичне теорије уставотворне власти као израза народне суверености. Полази се од става да је уставотворство традиционално схватано као унутрашње питање државе, али да је након Другог светског рата, услед интернационализације људских права и јачања међународних институција, дошло до отварања уставних процеса ка спољним утицајима. У том контексту, Комисија се посматра као независно консултативно тело чији ауторитет не почива на правној обавезности, већ на експертизи и институционалном дијалогу. Рад показује да Комисија, иако формално не ограничава уставотворну власт, посредно утиче на уставотворне процесе кроз развој процедуралних и материјалних стандарда заснованих на демократији, људским правима и владавини права. Посебно се указује на савремене изазове улоге Комисије у условима кризе међународноправног поретка.
