USTAV REPUBLIKE SRBIJE IZ 2006. GODINE I NAČELO PRAVNE DRŽAVE – MIT ILI ISTINA?

Sažetak

Mada se pojmovi pravne države i vladavine prava danas uglavnom smatraju sinonimima, u radu se ukazuje i na neke njihove suštinske razlike, imajući u vidu vrednosno opterećenje pojma i koncepta vladavine prava. Nakon komparativne analize velikog broja evropskih ustava u kojima je konstitucionalizovano načelo pravne države (vladavine prava), ustanovljeno je da najveći broj evropskih zemalja usvaja koncept pravne države, dok su u manjini države (bivše jugoslovenske republike, osim Slovenije) koje polaze od vladavine prava kao osnova državnog ustrojstva. Taj terminološki manir na prostorima nekadašnje Jugoslavije verovatno predstavlja danak olakom ili politički željenom preuzimanju ovog pravnog instituta iz uglednih evropskih ustava, kao i posledicu nedovoljno opreznih pravnih transplanata. Naime, u zvaničnim prevodima evropskih ustava na engleski jezik skoro bez izuzetka se termin pravna država prevodi pojmom vladavina prava – rule of law. Autor analizira oko 20 ustava evropskih država i dolazi do zaključka da se u velikoj većini njih, na izvornim jezicima tih zemalja, u njihovim ustavima koristi termin koji i lingvistički odgovara pojmu pravna država, a ne pojmu vladavina prava. To nije slučaj sa Ustavom Republike Srbije iz 2006. godine. U radu autor kritikuje rešenje i način na koji je u Srbiji 2006. godine konstitucionalizovano načelo vladavine prava. Pored nepotrebno čestog pozivanja na vladavinu prava, uz bespotrebno opterećivanje normativnog teksta nabrajanjem i objašnjavanjem principa vladavine prava, naš ustavotvorac se nekritički priklanja rasprostranjenoj, u osnovi univerzalističkoj (liberalnoj) verziji vladavine prava, koja je bar mogla delimično da se prilagodi društvenim specifičnostima Republike Srbije. Na kraju, autor se zalaže za ustavno prihvatanje načela pravne države koje je mnogo bliže ustavnom identitetu Republike Srbije, odnosno pravnoj tradiciji na kojoj on počiva.
