SRBIJA – SAVREMENI SOCIJALNI I POLITIČKI IZAZOVI

PREOBLIKOVANJE ODREDBI AHTISARIJEVOG PLANA: KULTURNO I VERSKO NASLEĐE I POSTKONFLIKTNI SPORAZUM BEOGRADA I PRIŠTINE

Sažetak

Rad identifikuje mehanizme zaštite srpskog verskog i kulturnog nasleđa na Kosovu definisane Ahtisarijevim planom i analizira njihovu dosadašnju primenu. Autori imaju za cilj da ukažu na to da status srpskog kulturnog nasleđa na Kosovu uključuje ali i nadilazi pitanja zaštite, očuvanja i neometane upotrebe u verskim obredima. Kulturno nasleđe ima duboko politički kontekst, koji je do sada bio zanemaren u srpsko-albanskim odnosima, sa uverenjem da će širi sporazum o statusu relativizovati pitanja kulture i identiteta. U prvom delu analiza daje sveobuhvatan pregled pravnih garancija i iskustva u njihovoj primeni, detaljno se bavi primerima zloupotrebe i nepoštovanja usvojenog normativnog okvira, kritikom „posebnog“ statusa za srpsko nasleđe i otvorenim sporovima između Srpske pravoslavne crkve (SPC) i vlasti u Prištini. Ključni nalaz analize je da sadašnje ustavne i zakonske garancije ne mogu biti trajne i efikasne u potpunoj zaštiti srpskog kulturnog nasleđa na Kosovu, kao i da postoji dugogodišnji jaz između propisanih normi i njihove primene u praksi. U drugom delu, tekst daje uporedni pregled posebnih statusa svetih mesta u Evropi. Budući da se eksteritorijalni status često pominje kao konačni model za srpsko versko i kulturno nasleđe, rad je pokušao da ponudi i nekoliko modela teritorijalnih rešenja za manje jedinice, u obliku enklava, eksteritorijalnosti i kondominijuma. Na kraju, autori vrše pregled dosadašnje literature posvećene kulturnom nasleđu u postkonfliktnom periodu i ukazuju na odsustvo univerzalnog normativnog okvira i mehanizama zaštite uprkos razvoju različitih međunarodnih instrumenata.
