POLITIKA PRAVA NA PRIVATNOST I ZAŠTITA PODATAKA O LIČNOSTI NA INTERNETU: STUDIJA SLUČAJA TURSKE
Sažetak
Pravo na privatnost i pravo na zaštitu podataka o ličnosti postaju jedno od najznačajnijih pitanja u oblasti vladavine prava i poštovanja fundamentalnih prava i sloboda. Razvitak modernih tehnologija, a pre svega interneta je doprineo uvećanju značaja ovih prava ali i sve većoj pažnji koju im nacionalne i međunarodne institucije pridaju. Republika Turska, kao jedna od najznačajnijih država na međunarodnom planu, po svom strateškom položaju, ekonomskoj, političkoj i vojnoj moći, dospela je u središte interesovanja medija, međunarodnih i nadnacionalnih organizacija poput Ujedinjenih nacija i Evropske unije u kontekstu procene poštovanja ljudskih prava i sloboda. Političke promene nastale usvajanjem ustavnih amandmana koji su načelno prepoznali značaj navedenih prava, suprotno očekivanjima, doprinele su njihovom većem kršenju i rastu moći izvršne vlasti, pri čemu turski politički sistem sve više dobija karakteristike hiperprezidencijalizma. Osnovna pitanja na koje će rad nastojati da odgovori odnose se na rasvetljavanje stvarnog značaja i sadržaja ovih prava, postojanost turske legislative u odnosnoj oblasti i ispitivanje uticaja legislative na stvarno stanje po pitanju njihovog poštovanja. Budući da je Republika Turska država koja pretenduje na članstvo u Evropskoj uniji, biće neophodno razmotriti i pravno nasleđe Evropske unije u ovoj oblasti.
